TikToker Kakan Maiyo Released on Bond Following Incitement Arrest

Popular Kenyan TikToker and entrepreneur Godfrey Mwasiaga, known online as Kakan Maiyo, was released on Ksh 10,000 police bond on Thursday following his dramatic arrest earlier this week on allegations of inciting violence against police officers.

Maiyo, who commands a large online following for his bold social commentary and critiques of government misconduct, was arrested on Tuesday, July 9, by officers from the Directorate of Criminal Investigations (DCI). He was picked up at his business premises in Kimathi House, Nairobi, and held at Muthaiga Police Station for two nights.


The Allegations

Authorities accused the content creator of posting a viral video on TikTok in which he appeared to issue warnings directed at law enforcement officers allegedly involved in recent enforced disappearances and extrajudicial actions.

In the video, Maiyo said:

“A time is coming when you will go to abduct someone and not return… Your families will cry the same tears as these families have cried. No amount of arrest, abduction, or killing will silence Kenyans.”

The DCI stated that such remarks could be interpreted as incitement to violence and a potential threat to national security. His arrest followed increased government scrutiny of online content creators in the wake of widespread protests across Kenya over police brutality and governance issues.


Released Without Charges (Yet)

Despite the arrest and two days in custody, Maiyo was not formally charged in court, raising concerns among his supporters and legal observers about the legality of his detention.

His legal team, led by Law Society of Kenya (LSK) Vice President Mwaura Kabata, condemned the arrest, terming it “unwarranted and unlawful.” They argued that Maiyo’s statements were expressions of opinion and concern over state violence, not incitement.

“Freedom of expression is protected under the Constitution. Our client spoke about the pain of many Kenyans. Arresting him without due process is intimidation,” Kabata said.

News of Maiyo’s arrest triggered swift reactions on social media, with hashtags like #FreeKakanMaiyo and #FreedomOfSpeechKE trending for hours. Many Kenyans saw the arrest as a government attempt to silence dissent and intimidate digital activists who have been vocal about human rights violations during the current wave of protests.

Civil rights groups also weighed in, calling the arrest a chilling warning to outspoken citizens and creators.

On the other hand, some security officials defended the move, saying inflammatory language—especially during a volatile period—could further endanger public safety and provoke unrest.

The DCI has not confirmed whether formal charges will be filed, nor has Maiyo been summoned to appear in court. Legal analysts suggest that the state may still pursue prosecution under Kenya’s National Cohesion and Integration Act, which criminalizes speech that could incite violence or cause disharmony.

As of now, Maiyo has remained silent on social media since his release, and it’s unclear whether he will address the incident publicly.
