Former Chief Justice David Maraga’s security detail was abruptly withdrawn on June 26, raising concern and public debate over what appears to be a politically charged move by state agencies. The action comes just days after Maraga participated in public remembrance vigils held across the country to honor victims of state violence during anti-government protests.
Multiple reports, including those from ChimpReports and People Daily, indicate that Maraga’s security was pulled without formal notice or explanation, prompting speculation that the decision was retribution for his vocal support of civil liberties and his appearance at the June 25 vigils. These gatherings were held to commemorate the lives lost during last year’s nationwide demonstrations against the now-defunct Finance Bill 2024.
In response, the retired Chief Justice is invoking constitutional protections, citing provisions that guarantee the security and welfare of high-ranking former state officers. According to legal experts, individuals who have held constitutional offices such as Chief Justice are entitled to state protection due to the nature of their previous roles and the potential risks they face.
Speaking through his legal team, Maraga stated:
“This is not just about me. It’s about the independence of the judiciary and the right of every Kenyan to speak truth to power without fear.”
The Judiciary Watch, Law Society of Kenya (LSK), and several civil society organizations have condemned the withdrawal as “irregular and intimidatory,” urging the government to reinstate his security detail and respect his constitutional rights.
Interior Ministry officials have yet to comment on the matter, though a senior source suggested the move may have been prompted by Maraga’s “recent political posture.”
This incident adds to growing concerns about increasing crackdowns on dissent and perceived threats to Kenya’s democratic institutions amid ongoing unrest and a widening rift between the state and sections of civil society.
