Simon & Sarah Kabu Face Ksh 21M Lawsuit from Former Nanny Over Harassment & Privacy Breach

In a developing legal battle, Simon Kabu and his estranged wife, Sarah Njoki Nyaga, co-founders of Bonfire Adventures, are facing a lawsuit filed by their former nanny, identified in court documents as JK. The suit, lodged in the Employment and Labour Relations division of the High Court, seeks over Ksh 21 million in damages, alleging sexual harassment, breach of confidentiality, and reputational harm.

Allegations Detailed in the Lawsuit:

  • Sexual Harassment: JK claims that Sarah subjected her to sexual harassment, for which she is seeking Ksh 7 million in compensation.
  • Breach of Confidentiality: The lawsuit alleges that Simon unlawfully released CCTV footage from their home, leading to a breach of confidentiality and privacy. JK is demanding an additional Ksh 7 million for this violation.
  • Reputational Damage: JK contends that the leaked footage subjected her to cyberbullying and defamation, causing significant mental anguish. She seeks a further Ksh 7 million for the reputational harm suffered.

Background of the Dispute:

In June 2024, JK was employed as a nanny and homeschool teacher for the Kabus’ two children. She alleges that her employment was a facade, intended to use her as a scapegoat in the couple’s marital conflicts. The situation escalated in July 2024, when Sarah, suspecting an affair between JK and Simon, allegedly attacked JK with a kitchen knife, resulting in injuries. JK reported the incident to the police and sought medical attention.

Following the altercation, CCTV footage from the Kabus’ residence surfaced online in December 2024, leading to widespread public scrutiny and speculation about the nature of JK’s relationship with Simon. JK maintains that she was unaware of the surveillance and did not consent to being recorded, asserting that the release of the footage violated her constitutional right to privacy.

Legal Proceedings:

Simon Kabu has challenged the jurisdiction of the Employment and Labour Relations Court to hear the case, filing an objection to have the suit struck out on these grounds. The case is scheduled for mention before Justice Bernard Matanga.
